District Attorney Steve Tyler violates his own requested mediation agreement.


Not so long ago, Steven Tyler sat down with Victoria Police Chief, Bruce Ure, and Victoria County Sheriff, T. Michael O’Connor, to hash out several areas of dispute.

Long story short, an agreement was reached that all sides agreed to abide by. One of several areas of contention was Tyler’s use of subpoenas to harass and cause hardship on officers.

Prior to Tyler’s taking umbrage at a perceived slight on his honor (he has some?) Law Enforcement officers received adequate advanced notice of dates and times that they would be required to appear in Grand Jury or in Trial Court for cases that they were involved in. Anywhere from one to three months in advance. This is so that Officers and their department can make adjustments to the work schedule and or scheduled training, Days Off, Off Duty Jobs, and personal vacation, to insure the officer was available to appear in court or Grand Jury hearing. After Tyler went out to smear the good name of VPD and to a lesser extent the VCSO as well, Tyler started waiting to the last minute to inform the departments of when Officers were needed to appear. He would also subpoena multiple officers (up to and including an ENTIRE SHIFTS worth of officers) to appear on the same day at the same time to wait all day to give their testimony on various cases. This was and IS unacceptable.

During the mediation it was agreed upon that Tyler’s office would give at least a 14 day (two week) notice of court appearances when practical. To this day, Tyler has not found one practical moment it appears.

From the very moment the agreement was reached Tyler has still been doing the same tactics of subpoenaing officers with little to no warning. Multiple officers have been receiving notice from 7 days prior to as little as less than 24 hours. Also he has still been requesting multiple officers to appear and await his pleasure and will when they have better things to do.

Back before the mediation Tyler has made the claim that he has to do this because officers were not showing up to their hearings, etc… This simply is not true. Only one officer in all that time did not show and that was because the request was sent on the officer’s day off and could not be reached in time.

Despite all of this, despite the hardship it is placing on the department to cover last minute schedule changes to insure officers on the street.

Despite the burden it places on officers to delay or cancel their personal time with family.

Despite the fact that officers have scheduled schools and extra training that is set well in advance and now must get canceled because of Tyler’s whim.

Despite all this, The Victoria PD is doing everything they can to insure officers are there when needed for court cases.

And here is the real kicker.

THEY DON’T HAVE TO!

That’s right. They don’t have to.
Why?

Because Tyler is not following procedures. It’s inappropriate to say right now that Tyler is subpoenaing officers; He is telling them when they need to be in court, but NOT via an official subpoena. Tyler simply sends an Email telling when a particular officer must appear.

No Subpoena
No official document
No official receipt
No official acknowledgment.

So in truth, an Officer has no legal compulsion to have to show up
Not by Tyler’s method

But show up they do despite all this

My hats off to the Victoria PD and ALL local and state Law Enforcement agencies for the jobs they do

And a big thumbs down for Tyler and his petty Sycophantic ways

  Tyler, that is just rubbish! Your ethics (??) stink! I think may be it is time for Y-O-U: Tyler, to do a Civilian Ride-A-Long. (Of course I would hate to be the Officer that had to take this hot-aired-bore along all night!) How about a Saturday night, full moon, pay day when the government checks/ IRS refunds/etc are burning a hole in a drunk's pocket? One night when the crazies are cutting each other up over a football team and family members are interfering with the rendering of aid? How about on a drizzly, foggy hot sticky night when some lowlife decides to knock around *his woman* and when you arrive, you witness the babies screaming in fear as *daddy* punches Momma a few more times? How about a night when 10-50 majors (major car wrecks) are happening one right after another and you're first on the scene and a car is crushing a trapped teenager who whispers through gurgling, "please don't let me die"? How about a night when you are first on the scene where gang members has just shot rounds through a trailer and an innocent little boy has been hit in the head and his brains are spattered all over the bedroom wall?? How about a night when a toddler has been brought into ER because some sexual predator has raped him/her and you have to take the report without puking up your guts or wishing it was legal to shoot the SOB if you just knew where he was? How about a night when arriving at a home fully engulfed in flames and a distraught father is desperately trying to break-a-way from three officers holding him back, wanting to go in and save his family? How about riding on a night when a gas line breaks in the middle of the night, and a neighborhood must quickly be evacuated? How about "living up" to YOUR end of the mediation, Tyler? YOU have NO CLUE as to the REALITY of what our LE, Fire Department and EMS do on any given night. You are one naive DA! Tyler, when you ran for office, you said you wanted a SAFE place to raise your daughter and family. You continually discredit, antagonize and go out of your way to make the lives of officers of the VPD more difficult. Why? Your agenda is that of a taunting Bully. Have you ALWAYS been this damn irritable, unhappy or are you just plain mean?

My Brother is due in Court Tommorrow on a case. He was notified only yesterday. Tommorrow is his only day he has to spend with his two boys before going away for two weeks for a police training school for Traffic Investigation.

That is just one personal example.  The "several officers" that Tyler claims has not shown up in the past for court... is ONE officer. The notice came from Tyler's office the SAME DAY as the officer was to appear in court.

That Officer was OFF that day and could not be reached before the court time. THAT is the several officers that Tyler claims refuses to show up.

Prior to this "rift" law enforcement had a few weeks up to three months warning of when they were due to appear in court.

This petty manipulation that Tyler is doing is BS childish "im gonna get them back for making me look bad" crap.

Tyler... you are the ONLY one making you look bad,

DEAL WITH IT

Thank you for bringing this very real problem to light....officers have enough to deal with juggling these heroic jobs with everyday life and still they have to put up with these ridiculous issues.

It's funny....while this is and HAS been a problem, you see no articles on it....officers are not publicly complaining about these issues.....they are trying their best to accomodate his requests. They remain professional and curteous, as always.

Thumbs up to all of these guys for their hardwork and continued service to Victoria.
