Should we really trust the Texas Department of Public Safety?

While this is NO refelection on the vast majority of DPS officers in the field, it is nevertheless interesting reading:

Texas Department of Public Safety 6/26/08

Driver Records Bureau

P.O. Box 4087

Austin, Tx 78773

Attn: Joyce E. Stevens, Manager

Re: Correspondence dated 6/13/08 request for driving record of Kenneth Schustereit

Dear Ms. Stevens,

I sit here today totally mystified by your department’s fulfillment of my paid request for a copy of my driving record.

That the document is incorrect and the record incomplete is really no surprise to me. As public record proves I have been a victim of the Texas Department of Public Safety’s(DPS) grossly negligent practices for some 33 years.

The document I received lists five entries and I am aware that there should be at least seven from the first date mentioned to present day. You are missing at least two citations.

As I mentioned this is no surprise to me. In 2004 the DPS sold an obviously flawed criminal background on one, Kenneth Don Schustereit to ChoicePoint, Inc. which eventually led to a loss of employment.

That information listed one, Kenneth Dale Schustereit as a convicted felon failing not only to get the name correct but to relay the fact that he was convicted only of a misdemeanor! This, in spite of the fact that my drivers license clearly uses the middle name “Don!”

No! There are no surprises when dealing with the DPS in Texas. In a 2005 interview with Wired Magazine DPS admitted that up to “…29% of our records are either incorrect or incomplete.” An Open Records Request I filed that same year revealed that DPS took in more than $58 million in revenue selling both driving and criminal records!

Are you aware that when an officer calls in a driver’s license he is placing his life in your hands to provide the correct, up-to-date information he needs to complete his duty? Those officers in the field depend on you! What about them? Are they now supposed to believe anything you say?

In light of the miserable, irresponsible, and I believe criminal, nonfeasance DPS record keeping displays, how can anyone be confident in your ability to provide the correct information?

By DPS’ own public statement you are convicted, in the eyes of the people of this state, of gross incompetence and flagrant irresponsible actions!

How, in the name of Almighty God, do you people sleep at night? The State and National flags that fly over the DPS campus in Austin should be lowered and replaced with simple black flags until the Texas Department of Public Safety can be overhauled to protect the people of this state from the likes of you!

I shall remain:

Still seeking justice,

Kenneth Don Schustereit

rainwater: My former Pastor is a Lowe's employee as well as a long time employee I worked with at Brown & Root. No dice! I bought a few items several months ago and left the store. Got home and found they had undercharged me by $65! Went back to the store and showed them the ticket and the item they didn't charge me for. Spoke with one of the managers about this and he couldn't believe I came back. I reminded him him that Lowe's had me barred from employment. He couldn't believe that either! Bottom line: I still can't work at Lowe's! Bought a dryer, a water well pump and plumbing($540) and a DeWalt sawzall and drill set there. Still can't get a job there! My resume had seven glowing letters of recomendation attached and I'm still persona non grata at Lowe's! 33 years is a long time to hold something against someone!

Eh! I'm used to it! The police officer who arrested me 33 years ago was former State Senator Kenneth Armbrister whom I voted for when he first ran for the senate. Bring up my name today and the first thing that pops out of his mouth is, "I arrested him!" He's done this at public football games in the stands, in the pressroom at the Advocate, the isles at Sam's, and at a Lion's Club meeting! Chuckle! Considering his political carrier it's probably his best claim to fame!

You are funny, but correct.  there was an insurance ticket on my record when I requested it from back in the 80's.  The car was insured and I proved it and got a not guilty in muncipal court in corpus christi, but never the less, Im an offender.  Makes me wonder.  and if you need a reference at lowes, holler!

Mr Schusttereit, after reading and agree with some of your blogs, It seems to me that you are thinking about running for State Senate or State Rep against Hegar and Morrison in 2010? It is true,

I'd like to thank everyone for reading this! Every time the DMV/DPS give out incorrect or incomplete information they put an officer's life in peril or someone's employment at risk. You can't rent videos to the public without a criminal background check nowadays so thos checks must be accurate!

Neither Lowe's, Home Depot, WalMart or Sam's will hire me because of a 33 year old misdemeanor! In spite of the fact that I have an excellent resume and sterling work record for many years! I have two Honorable Discharges and a Service Citation. I have served on my church council and been a civic leader yet I am not fit to sell electrical supplies to the public at the above mentioned businesses!
