"Don't taze me Bro!"
After the extended war of words on the "Clubs should be held to the same standards" topic, I finally got bored and looked for another topic to “vent my spleen.” I noticed that texson1986 appears to be outraged by a Utah Highway Patrolman using a taser on a traffic violator who refused to obey a lawful order when told to “Stop!” “Turn around!” as the man walked away. The man first refused to sign a traffic ticket. He was then ordered out of his vehicle and told that he was being arrested for refusing to sign the ticket. He got out but decided he was going to re-enter his car after repeatedly being ordered to stop and was finally tased.
It’s my understanding that traffic tickets contain a statement to the effect that signing it is not an acknowledgement of guilt, but only an acknowledgement of the receipt of a record describing a violation of a traffic law. This acknowledgement protects the violator by preventing the issuing officer from later adding other charges or “making something up.” The violator IS required by law to sign it or risk arrest. This amateur lawyer apparently felt that he didn’t have to obey a lawful order until he was given an explanation for being pulled over that satisfied him. He must have gained his knowledge of the law from watching too much TV since he claimed that the officer was also required to read him his rights. No so! That is NOT required at the time of arrest. Perhaps Danny Crane or some other legal beagle can share some insight here. texson1986 opened the door to my rant by asking >” Is this justified in your opinion?”< How can I reply to this without causing offense? To my mind, the officer should have aimed his taser so that the “prongs” would have been embedded in this self-righteous, Politically Correct jerk’s hind quarters and then pushed the “Discharge” button repeatedly until the whiner’s butt was too sore to sit down for a week! It just amazes me that people don’t think that they or others should be held responsible for their actions! Texson1986 also mentions that <” The part I really find interesting is how the officers all think the situation is so amusing.”< Yeah, I found it to be rather funny too, as the officer might have been motivated to shoot the "perp" in the leg. I was reading the thumbs up/down piece on today's (12/1) editorial page and I tend to agree with the comment about running news that's three days old - this story about the Utah officer and the taser incident is a perfect example - it was uploaded to Utube on Nov.23rd, and Texson posted his comment on the 29th. Seems the Advocate needs to have at least one full-time person scanning the UP and API wires for current news items. posted by

Sandwichh, I thought I heard about it somewhere, and a quick google search pulled up a site discussing sixty (60) pepper spray or oleoresin capsicum (OC) related deaths. Appparently with some people with heart conditions or heath problems with reduced lung capacities possibly run a serious risk of death after being sprayed - that is, the pepper spray itself is not dangerous but the stress on some people sprayed with it can be harmful. Sooo, I agree with you....just sign the damned ticket and don't argue with the police officer. posted by

Hey, Sandwichh, I like your comment about your children and finding spouses. I'm already setting my three sons and daughter on the path to bypassing some problems of the opposite sex, and my oldest is 10. I joke around with some mothers up here in Lavaca County about arranged marriages, but deep down, I'm not lauging too much. Glad to hear that your 20 somethings are not catching the first train that comes along. It can be devastating.

Surlee I actually agree with a couple of your points, but here is my take on the situation. You do “NOT” have to sign a ticket in order for it’s service to be perfected. You're not going to avoid the ticket just because you didn't sign an agreement to appear. You have to appear anyway. I agree the guy should have just signed the damned thing. He would have most likely won in traffic court in the first place. All that being said there was no need for the Officer to pull the guy out of his SUV and play macho que muy macho in front of his pregnant wife. The officer SHOULD have just given him the ticket and that would have been that signed or unsigned. Long live the Republic, Tex posted by

Well I see the teeny bobbers and the mom's are still at it on the other thing. I guess that's why when I ask my two sons who are in their 20's about the marriage thing they tell me, "Dad you don't understand what we have to choose from nowadays". You gotta laugh. And my wife understands, the evil conservative she is. : 0 ; )
And the taser thing, I am not sure. Having had a few heart things I can understand people and the taser scare. You never know. Like you said to make sure it is in the back or back side. Since there was no violence maybe the pepper spray could have got the job done okay without the shock effect first. With that good spray you can't see to drive, can't hardly breathe good, it's bad. But like you said, if you just do what the officer said to begin with nothing would have happened. He ain't going to change his mind when he starts writting the ticket. posted by

This type of thing reminds me of some of the parents who try to go against school rules, with the recent haircut episode, and even the parents of the girl in Cuero who didn't make the cheerleading squad. Sometimes, these kids grow up to think rules don't apply to them. Why not, Mom and Daddio blew them to the wind?

I completely agree. It's bad these days, people are always looking for a reason NOT to obey police officers. When it comes to law enforcement, unless your civil rights are being violated, just do as you are told. Even IF you think something is wrong, just try to cooperate anyways...if you are a suspect of some allegation and you are unsure just tell them you need to speak with your lawyer. It's not rocket science, it is commen sense. They are just trying to do their jobs and it doesn't make their jobs any easier when you get pricks like that who just have to test their limits.
