Why the Victoria 10 is seeking D.A Steven Tyler’s removal.

 

There are a number of reasons that we feel that Tyler should be removed from office because of official misconduct and incompetence!

 

Under official misconduct is the fact that Tyler refused to review all cases presented to him by the Victoria Police Department and the Victoria County Sheriff’s Office from mid October, 2007 till mid January, 2008.  That means well over 300 cases from the VPD alone.

 

I felt it might be of interest to the average resident of Victoria County to know what kinds of crimes people were arrested for and then set free on Personal Recognizance Bonds because they weren’t afforded a speedy trial.  This information is from the VPD"s 2007-2008 Case Presentation Log-Adult

 

Violent Crimes - 42:

Aggravated Robbery (this means with a weapon) – 1

Assault with a weapon – 3

Assault with DWI – 4

Assault - 30mes, people were arrested as follows:

 set free on personal recognasence bondseview all the cases presented to him by the Victoria Police department and the Vic

Deadly Conduct – 3

Intoxication Assault, 2 Counts of Manslaughter - 1

 

 

Driving While Intoxicated - 40:

DWI - Reckless Driving - 1

DWI – Second or More Offenses – 25

DWI – First Offense – 14

 

 

Theft, Robbery or Burglary -77:

Robbery – 1

Theft – 72

Theft of Fire Arm - 2

Burglary – 2

 

Various Drug Charges - 65

Possession – 60

Possession - Manufacturing or Delivery – 5

 

Miscellaneous Crimes Including:

Forgery

Evading Arrest

Criminal Mischief

Unlicensed Possession of a Fire Arm by a Felon

Unlicensed Possession of a Fire Arm

Reckless Driving

Criminal Trespass

Terroristic Threat

Selling Stolen Material

 

You see, any resident, including members of the Victoria 10, could also have become victims of these people – whether a victim as a result of a violent crime   or as a victim of a motor vehicle accident caused by a drunk driver….42 PEOPLE ARRESTED FOR VIOLENT CRIMES PLUS 40 DRUNK DRIVERS WERE TURNED LOOSE ON OUR STREETS AND HIGHWAYS…. ALL AS A RESULT OF A POWER-CRAZED D.A., UPSET BECAUSE HE COULDN’T LEGALLY GET HIS WAY.   

 

Next we have the situation with Mike Ratcliff.  All of the local District Judges have recused themselves from the case to avoid the appearance of impropriety because they have worked with Ratcliff while he was sheriff.  Our peerless D.A. however, claims that the fact that he was the man’s boss for ten months is no reason to recuse himself – public perception of impropriety be damned!

 

Then we have the notes attached to cases he reviewed and rejected – notes in which he made  unprofessional remarks about investigating officers and derogatory remarks about the victims.

The Advocate requested copies of the notes and cases, but Tyler refused.  The Advocate then appealed the situation to the Texas Attorney General.  After review the A.G. said there was no problem with releasing the notes -  any information that could compromise on-going cases as well as the names of victims could be blackened out.  Tyler appealed to a District Judge from another county to keep the documents secret, but the Judge turned the case back over to the A.G. Tyler has one last chance to appeal to the A.G., but it’s unlikely he’ll be successful this time either.  THEN the public will have a chance to judge Tyler’s lack of professionalism.

 

Tyler supporters have ask me why I’m being so vindictive against this egotist – it’s not vindictiveness to be upset that the D.A. deliberately made the wheels of justice grind to a halt – it’s a matter of being highly dissatisfied with a lack of professional judgment – my tax dollars are helping to pay this man’s salary and I, for one, have had enough!

 

I’ll leave examples of Tyler’s incompetency for another post.

Well let's see, southtexas.....

Buchanek was investigated by the Sheriff's Office as a person of interest because a blood hound followed a trail from the victim's house  to his house .... he was NEITHER charged nor ARRESTED. After further investigation, the S. O took him off the list of persons of interest - NOT the D.A.

Buckner was arrested before Tyler took office, but Tyler was the D.A. who took Buckner's case to the grand jury. Tyler has bragged about how much better his investigators are than the police - well apparently not that much better huh? So you're  standing up for TWO victims as opposed to the FORTY-TWO victims that Tyler ignored - isn't that a case of overkill?  Oh well at last you recognized that there were victims.

You say I hate Tyler, as I said before I don't - I just think he's incompetent. You on the other hand seem to believe that Tyler walks on water. I guess when it all comes out in the wash, we'll see who was right.

You're entitled to your opinion of course, but I have a clearer picture of the Constitution than you do - I understand that I do have a right to peacefully petition for the redress of grievances - apparently you don't get it tho'.  I never claimed that the police don't make mistakes, but Tyler deliberately brought the wheels of justice to a grinding halt.

Are you suggesting that you know more about the "detailed rules that apply to gathering and presenting evidence" than I do?  if so, what's your background and how can you tell how much I know or don't know about those rules?

Yes, indeed, Tyler did what he felt he had to do….Instead of reviewing the police reports and questioning them for any necessary evidence, he just REJECTED everything without review or publicizing any poor investigations in the news – he certainly didn’t hesitate to make on-going comments about everything else. However, his method put violent perpetrators and drunk drivers back on the streets. Don’t you wonder how the victims of those assaults felt when that happened – particularly those cases involving spousal abuse? Can you stand there and tell me that if you were one of the victims of assault you would have felt ol’ Stevie was doing the right thing? I don’t HATE Steve Tyler, I just want this incompetent, egotistical, fool to be removed from office and if you had the least bit of concern for the victims, you would too!

1. The police DID their jobs – they responded to crime scenes, investigated, arrested the perpetrators, and sent a report to the D.A. Your hero, however, DIDN”T do his job – instead, he essentially resorted to blackmail by trying to get public opinion to force the police to agree to sign his ridiculous affidavit.

2.The Advocate posted a copy of the outrageous affidavit he tried to get law enforcement to sign,.. Instead of running your mouth and crowing like a sick rooster - try comparing that to the one law enforcement agreed to – worlds of difference. You still haven’t commented on the victims of those violent assaults who were left hanging by his sorry tactics. It’s obvious that you don’t care one whit about the victims. You’re as sorry as your hero!

It continues to amaze me that all of you Tyler Haters totally ignore the large role the Sheriff and Police Chief have played in this whole escapade. 

Tyler did what he had to do to get people's attention to the fact that Law enforcement leadership (not the cop on the beat) were not doing what they needed to do to make sure the criminals that were arrested could be prosecuted and put away.

  We have two law suits now pending related to lack of evidence.  But that's okay?????.....Tyler tried to work with LE in the beginning.... see what it got him.  Hopefully there won't  be any more lawsuits since the LE has accepted a higher degree of responsibility for their work.

  Arresting people isn't all there is to it.....YOU HAVE TO HAVE A CASE THAT WILL STAND UP IN COURT!!!

I don't think the release of  these individuals should rest entirely on the shoulders of the DA.  Officers made a choice to not "swear" to their knowledge and investigation KNOWING these were "VIOLENT CRIMINALS AND DRUNK DRIVERS."  And by the way, Shurelee, Tyler did legally get his way!  Law Enforcement is now signing an oath without the word "affidavit" at the top.

I also voted for Tyler.  I cannot WAIT until I get the chance to get him out of office and off my taxpayer dollars.  What refuse!

I have refrained from ever commenting on this hot topic for a while now, so here goes. I voted for Tyler, but whether or not I voted for him is not at issue. What is at issue is how he chooses to conduct  "official business"  on tax payers dollar. I feel that citizens have every right to question, scrutinize or even complement & praise an elected or appointed public official.

I have soooo many questions for Mr Tyler, as a tax paying registered voter here in Victoria.........

What was his staff doing from 10/07 till 1/08, besides PR ??

Was he & his staff collecting paychecks for NOT prosecuting cases???

Since there is now a back log of cases due to Mr. Tyler , will he and his staff get overtime pay to get these cases prosecuted??

Why has every judge here recused themselves but Tyler has not from the Ratcliff case??? Tyler was the man's boss for crying out loud.

Why is he so adamant about not releasing his offices "hand written" comments to the public??  My Mom will look at me and say... I know what you are thinking, you better not say it. If Mr. Tyler was dumb enough to leave a paper trail, the public has every right to know. This was after all done on tax payers time & $$$.

How much is Mr. Tyler costing the county with the appeals on his "hand written" comments??

It seems to me that all the other agencies(sheriff & PD) have been working and doing their jobs during the 10/07-1/08 time frame. Mr Tyler was not. This even was echoed with a letter from Judge Laura Weiser.

Yes, I think we the people have every right to question Mr. Tyler actions. He says he is a prosecutor, not a politician. Mr. Tyler you did not prosecute for four months! You were too busy being a politician!! I'm very disappointed in who I voted for!

I hope all the law enforcement agencies look at the fire department and see what leadership and team work can accomplish!! Great job firefighters!!! Thank you

   I am glad to see SOMEONE stand up in an attempt to improve the justice for the victims in this county! I have a difficult time believing that the District Attorney would sit on his big butt and let 42 VIOLENT offenders and at least 40 DRUNK driving offenders, WALK!  What the H$JJ is this man still doing in office?

  VICTIMS of any of the crimes listed above, should come forth and sue the waz-O-la out of Tyler. Victims should be able to have their day in court. What kind of incompetent nincompoop is being allowed to even enter the sacred halls of justice, the courtroom? This is a sad state of affairs for the citizens, even sadder for the citizen-victims.What message are we sending to these poor victims? Dangerous offenders were sent back into the community.  It is very sad to see these criminals go free because of Tyler's refusal to review their cases. 

   Isn't it the job of the DA to help protect citizens by representing the State in prosecuting those criminals before a jury of their peers? Those who are found guilty would then be sent to jail or removed from society.

    All efforts should be made to rid Victoria of this incompetent DA and time be invested by a District Judge in selecting a highly skilled experienced Prosecutor in an endeavor to restore hope in our criminal justice system. 

Justice DELAYED is justice DENIED.
