Employeer did a local employee very wrong
This day and time, work is very inportant to anyone to just make a pay check, with the cost of living going higher daily. Some of us strugle daily yo do for there self and family to make it easyer. Then there boss isnt that great cause he is money hungry. A local man recently did his job faithfully, and gave eveything to complete his task at work. Not long ago this man was hurt doing his job dutys that he was trainned to do by his supervisor. And it ended the worker to be placed into the hospital for a short time. While the employee was in the hospital the company employeer kept tabs on him all the time due to injury. When he was sent by almbulance to the hospital the mananger of the company told the hospital the injured worker was cover by Texas workers comp. After the worker was out of the hospital, the medical bills started comeing in and it wasnt cheap. First of all the employee went to his employeer and explained he couldnt work for a short time of a few weeks due to his work related injury, the company become madd at the worker like it was not right to be out on medical leave by orders from the doctor. Soon after words as the medical bills was coming in , the worker become a little worried why workers comp hadnt kicked in. Tryed to contact the company owner, and he was very upset and wanted to do a seetlent wiht the hospital and pay so much and wanted the worker to pay the rest, rememebr now this worker was hurt on his normal job doing his daily job dutys.. Anyways the worker trys to contact his big boss asking questions about the bills that are coming in. The company owner gets very upset and says he dont need to claim the job injury to workers comp. So the worker does it own self and files for workmans comp. The owner wouldnt even give the worker the workers comp insurance company. The worker finds out the inofomation and contacts the ttexas workers comp and finds out the insurance company, and files his own report to the insurance company. Soon after the worker talks to the insurance company, with then 30 mins the worker gets a phone call that he is now officaly fired and not given any grounds as why he was fired, and this was about 2 weeks after the injury. let me say he was fired while on medical leave from being hurt on the job. Isnt it not right that a employyer fires a worker on medical leave from a work related injury ? Just shows that some company owners dont care about the workers, cause they are money hungry owners. Now this guy has lost his job and strugles to pay his bills its just not right. I guess my point is, people be aware about your job if you do get hurt, casue it can happen at any given time no matter how safe you or others are as this worker was daily. be aware is to be alive, and this worker almost lost his life with his injury. When he was brought into the ER the ER doctor said he was on deaths door, it was that serriouse. But he is alive and will continue to live. 6 comments from 6 users

This employee needs to contact the Workforce Commission. If he were "fired" or "let go", he may be entitled to unemployment benefits. I'd also recommend that he talk to an attorney. Call around locally. Many attorneys have a free or a "cheap" initial consultation. I don't know much about Texas Employment Law, but I have heard that if you are injured on the job and are under a physcian's care, you cannot be fired. Now, when the employee returns to work after being cleared by the doctor, the employer can then use the "at will/at leisure" termination.... they aren't required to give a reason. Except if they are disputing the unemployment benefits. posted by

If all the facts are as you presented them I'd say that boss was very closely related to that green & white stuff on a henhouse floor. Does anyone need me to make that any plainer? posted by

My father was hurt badly at one of the area plants (a really big one, that employs lots of people) years ago, in the construction part. A serious back injury. He tried to work, but the pain was too severe. After missing a few days of work, he was laid off from his job. A reduction in workforce. The next thing you know bills started becoming over due. He lost his home. His medical bills were gaining on him. He lived in a travel trailer for a year. Then he hired a lawyer........They sued, turns out this company didn't report a lot of their injured workers. Makes their sign look good when it reads "200 days with no injuries!" Needless to say, my dad won a settlement, not enough to stop working, after multiple back surgeries. But he got back on his feet again. So call your lawyer and see if you can afford a Doctor. That's what they used to say in the oil field. "The only right the working man has--is to quit." That's what dad would say. God rest his soul. Sure do miss him. posted by

If you told me what employer that was, I would stop supporting him/her. If anyone pays you more than minimum wage around here, they make you do twice the work.
