Illegaler??
I keep seeing stories in the blotter about people being arrested for possession of illegal drugs in a drug free zone. Now, since possession of illegal drugs ANYWHERE is already illegal, it does my heart good to know that possession of illegal drugs in a drug free zone is illegaler. When it comes to common sense, this is right up there with hate crime where it is somehow worse to beat up someone you hate than -- oh, I don't know -- beating up someone you like?

The blog reminds me of the legislation to create enterprise zones. I had always been under the assumption that the United States is an enterprise zone. But then again, when you consider all the regulations an owner must navigate to run a business, maybe the legislature is tacitly admitting that we no longer truly have free enterprise. Nice transition there, Spock. I was following your train of thought pretty well, and then - BAM!

You might find the "blog" (actually, it's an essay), I've just posted here interesting. Actually, the laws which you refer are more due intolerance and bigotry of the public than of legislators. Decades ago, a German scholar named Etienne deGraaf predicted in a book - "Untergand durch Instinkt" (decline through instinct) - that the people of the United States would legislate themselves into virtual prison. Desirous of total safety, he said, they would instinctively seek the only place where that is possible, the societal womb that is prison. DeGraaf noted that societies dominated by women invariably choose the refuge that is the group, and the apparent safety of prison. The historian Gibbon noted of the ancient Athenians that "more than freedom, the Athenians wanted security; eventually, they had neither freedom or security. " However justified it may have been at the outset, feminism is the cancerous cell that is destroying the U.S. Its rise has seen our parallel national decay, a fact that is seen everywhere - especially in the kind of laws you mention.

Anything illegal is not more or less illegal than something else illegal. What differs is the punishment. Stealing is not "Less Illegal" than Murder. something is either illegal or its not.. there are no grades of illegality. the categories of crime , ie a Class A,B,or C misdemeanor, State Jail Felony, or a 1st,2nd, or 3rd Degree Felony are not levels of illegality, but punishment levels for the seriousness of the crime. It may seem like a fivolous difference, You say "Po-TAY-toe" I say "Poh-TAH-toe" type of thing but its not. Having drugs inside a drug free zone is not more illegal than having drugs elsewhere. Both are illegal. but having drugs in an area designated as a drug free zone carries a more severe punishment. Most drug free zones are schools. The more severe punishment is to help deter the selling of drugs to children at schools. But the DA has made it abundantly clear he does not agree with the Legislature who created the drug free zone laws. and has repeatedly refused cases based on them. And no that is not unsubstantiated.. go check the original 8 letters between the DA and Chief Ure that was attached as a PDF to the original Article on the rift. "Da's Actions Alarm Law Enforcement" dated August 12 2007 by Gabe Semenza. One of those letters covers this very thing. Aparently Steven "I Follow the Law" Tyler only follows his personal interpretation of the Law. not what the law states.
