warrior - fyi...here is TEA's POLICY...your reference is somewhat outdated
Section 573.041, Section 573.041SS, prohibits employment of a relative of a school board member within the third degree by consanguinity (blood relation) or within the second degree by affinity (marriage), except that employees continuously employed in a position for six months prior to an election other than general election, or one year of election at the general appointment of a relation board member, may continue to be employed in that position.
Exemptions to the nepotism law occurs for the employment of bus drivers, if the school district is located either wholly or in largest part in a county with a population less than 35,000 and for an appointment or employment of a substitute teacher.

When a person is allowed to continue in employment under the exceptions authorized by the statute, the school board member who is related to the employee shall not participate in deliberation or voting on the appointment, reappointment, employment, reemployment, change in status, compensation or dismissal of the employee, if the action applies only to the employee and is not taken with respect to a bona fide class or category of employees, Section 573.041.
