Tyler's day of reckoning is drawing near. - The View From Here - ShureleeUJest's Blog - Victoria Advocate

Over the holidays, the Victoria 10 was finally able to consult with several attorneys on the procedures for filing a petition to have the District Attorney Steven Tyler removed from office. It took a while to locate lawyers willing to speak to us because none of the local attorneys dared to. The reason? Political considerations!

Below, I’ve cited the code under which we will file a petition for the removal of the District Attorney. We will file approximately a dozen charges under the definitions of Incompetency and Official Misconduct. We’ve completed a rough draft of the petition and are waiting for a review and any recommendations in the wording of the charges by the aforementioned attorneys. We also plan to file complaints with the Texas State Bar.

Once the petition is finalized and submitted, a copy of the petition with detailed charges will be posted in this blog.

It is good to see that you guys appear to have your ducks all in a row. Official misconduct: " unlawful behavior relating to official duties by an officer entrusted with the administration of justice or the execution of the law. The term includes an intentional or corrupt failure, refusal, or neglect of an officer to perform a duty imposed on the officer by law". I do believe this shoe fits!
I have been looking forward to seeing if "The 10" could actually pull this off. I would like to contribute monetarily to the cause, if I may, if you guys would accept a gratuity. I know from business that attorneys do not 'give away' their services; so if I may, is there an account set up or a way that I may deposit something into the kitty? I applaud your efforts. I am appalled at the lack of integrity and discipline of Tyler. As they say, "the bigger (he thinks-he is) they are, the harder they (he)will fall." Keep us informed, gentlemen and THANK YOU!!

Jan 6, 2008 at 02:01 AM : ...

In our United States, people, who are unhappy with their leaders, have not only an obligation but the freedom to organize and peacefully make the case for change --

We, the Victoria 10, who are fellow citizens of and taxpayers in, Victoria County, have chosen to bear the burden of responsibility to seek the eminent and official removal of Stephen B. Tyler as Victoria County's Criminal District Attorney. For justice to be served and to prevail, we have been active, not passive.

It is grievous to know that over 360 criminal cases have NOT being accepted for prosecution by our DA. The Victoria County Criminal District Attorney is to work WITH, NOT AGAINST law enforcement for the benefit of protecting the rights of her citizens. We perceive that in order for the wheels of justice to begin turning, Stephen B. Tyler must be removed from office. The Victoria DA can be removed by a petition of ONE.

Legal counsel has been obtained and we continue move forward. Tyler has selectively and deliberately refused to review and to act upon approximately 360 Victoria Sheriff Department's and Victoria Police Department's criminal cases. We, the Victoria 10, have accepted this responsibility to move forward with the petition for his removal. Prior to our decision to move forth, we had hoped that Steve Tyler would understand that all citizens and victims should be treated equally and that bullying law enforcement, and attemped intimidation of other citizens, has no place in Victoria County.

One should expect that the District Attorney of any given, Texas county, would know that as the Prosecutor for the State, it is not his decision as to conjure whom is "trial worthy" nor to pick and chose what cases he wishes to prosecute. He is to present cases to the Grand Jury and to let them decide whether there is evidence sufficient to indict.

It has become quite transparent to us that our DA truly has issues that are rendering him enable to due the job he was voted in and sworn to do. Justice is at a standstill in Victoria County. And if you don't believe it, people, put your ear to the ground . . . his blatant disregard for upholding the law, has tongues wagging in numerous and highly respected universities of law; some of which are in Texas.

First off...Themis you are retarded and completely close minded...
Secondly, lets get it straight. The DA is not declining cases....to DECLINE them would infer that he has actually looked at them and turned them away for whatever reason...Steve Tyler will not even allow the cases to be left in his office for review!
The consequences of his actions has let many violent criminals back out onto the streets...and some, back into their homes where the damage was done and will continue, thanks to MR. TYLER.
The almost 400 criminal cases sit in a growing pile at the Sheriff's Office and Victoria Police Department...police continue to do their jobs taking reports, detectives investigating the cases....and when the work is done the cases are added to the pile to collect dust rather than be reviewed...
Who is suffering? The people of Victoria! The VICTIMS of crimes are suffering everyday. And the offenders are enjoying the freedom of no prosecution.
VICTORIA 10: I am one of the many who are unable to stand up and against this scandal for so many reasons...but I support and appreciate your efforts more than you will ever know. Rest assured that while law enforcement agencies will maintain their professionalism, in silence, they appreicate you and you are probably just what this town needs. Sometimes even they need help. This is one of those rare opportunities for the citizens to make a stand when others can not. Thank you!

I wish you people would quit calling yourself the "Victoria 10".....That gives the impression that you in some way represent the people of Victoria, which of course you do not! You represent your own pompous opinions and need to be in the limelight.

Shurlee....you spend so much time spouting your opinion all over the comment sections of the paper, your blog, and other internet opinion sites, that I am seriously concerned about your gastrointestinal health. I mean do you ever get a chance to take a potty break? Of course that is your right and actually I enjoy reading your lengthy and self centered rants and in some rare cases agree with them.

This Victoria 10 thing is ridiculous. There is fault on both sides of the road in this issue, both with the D.A. and law enforcement. Demanding that both sides should negotiate and get things back on track is the rational thing to do. You have assumed who is wrong when you don't have a clue what is really going on. If you talk to some of the criminal attorneys in town, who have to deal with both sides and who want an end to this pissing match as much as anyone ....they will tell you there are ego problems on both sides in equal proportions. The law enforcement people don't want to sign anything because they don't want to be responsible for their sometimes sloppy, cutting the corners, work. A man was just released from prison for serving 26 years for a crime he did not do....26 YEARS!!! Can you even imagine. And what did he get....a rather hesitant "I'm sorry."

I am a "tough on crime" person. I believe in the death penalty! I believe the bad guys should be gotten off the street. What I do not believe in is the D.A. having to take cases that are going to get tossed because of sloppy police work. I do think the D.A. has an ego problem as bad as the "don't want to take responsibility" problems of law enforcement, but your personal vendetta against the D.A. is related to strong feelings about the Ratcliff case and the two are not really connected. The Victoria 10 are a group of pompous narcissistic individuals who want to make a grand show and serve their own need for the spotlight. They don't really want a solution....they want a show.

Jan 6, 2008 at 12:01 PM : It's NOT just 10...

It's NOT just 10 people. It might have started that way but the count is way over ten! And several people of the original group do have a clue what is going on. Many of us have actually gone downtown and spoken with elected officials and city officials. We've pulled so many public files that we each have a book now.

If the criminial attorneys southtexas speaks of actually do want it to stop, why haven't they done anything to help the situation? Why haven't the "powerful" people gotten involved and tried to help the residents of Victoria? Why haven't they offered any solutions? Why don't we start asking them? I'm actually glad this was brought up. Maybe we can get Gabe to ask them? Maybe we can start asking them on the record. Thank you for pointing that out. We will be sure to tell them that southtexas suggested we ask.

The man serving 26 years in prison for a crime he didn't committ did NOT live in Victoria. That crime did NOT take place in Victoria. That crime was NOT tried here in Victoria. The man was NOT convicted here in Victoria. And the man did NOT serve time in Victoria. I'm sure if he wanted to move to Victoria now we would welcome him.

What are we to do about the 300+ cases with the PD (I don't have a count of the SO cases yet) the DA has refused? What about all those victims? When will those victims ever get their day in court? And it isn't up to the PD, the SO or the DPS to decide who is guilty. It also is NOT up to the DA to decide who is guilty. Last time I checked it was up to a jury of 12 peers to decide who is guilty (or not guilty) based on evidence presented at the time of a trial.

You know, sometimes a District Attorney will win cases. And sometimes a District Attorney will lose cases. But a DA has to actually present cases in order to get either result. And our current DA is NOT even accepting cases.

This is not about any one case. Of course the Ratcliff case is not connected - because that man is actually getting his day in court. That man is getting a trail. That man has all the attention of the DA (especially since the DA is refusing cases - he has to be working on something)! So NO, it's certainly NOT about the Ratcliff case. Good on Ratcliff for having his day in court rather quickly I might add jumping over countless other cases.

It's not about getting attention or claiming the spotlight. Please!! I can think of a million things to get attention for and all of them are much more glorified than this issue. What personal need could this possibly fulfill for any person? Most of us actually have more to lose by exercising our rights as a citizen of Victoria. **And every resident in Victoria has so much to lose if something is not done soon.

**Please note that we NOT represent southtexas in our opinions. And thank you southtexas for "being tough on crime". I will be looking for southtexas to take some action for what he/she believes is right. I would hope that he/she would certainly be looking for a solution instead of just shooting down our solution.

Themis and southtexas,
Themis,
Thanks for your discouraging words, but the lawyers we consulted have explained that out of pocket expenses for filing the petition will at most be around $ 500 - well within the reach of average citizens who want to see the justice system get back on track.
southtexas,
Please don't worry your little head about my health, my wife is doing a fine job of keeping me on track. You say:
>"The Victoria 10 are a group of pompous narcissistic individuals who want to make a grand show and serve their own need for the spotlight. They don't really want a solution....they want a show. "<
Your comment is kinda strange - since we are anonymous, how are we seeking the spotlight? It's likely that most people will never know who we are. Rather than grandstanding, we are at least making an effort to get the courts back in action and perhaps a D.A. who will DO his job and stop his grandstanding.
I'm sure Tyler appreciates the loyalty of his staff, but if I were you, I'd pull out my resume and bring it up to date.

office.
(b) The judge may not suspend the officer until the person
appointed to serve executes a bond, with at least two good and

§ 87.017. SUSPENSION PENDING TRIAL; TEMPORARY
APPOINTEE. (a) After the issuance of the order requiring citation
of the officer, the district judge may temporarily suspend the
officer and may appoint another person to perform the duties of the
office.
(b) The judge may not suspend the officer until the person
appointed to serve executes a bond, with at least two good and
sufficient sureties, in an amount fixed by the judge and
conditioned as required by the judge.
In an action to recover on the bond it is necessary to allege and prove that the temporary appointee actively aided and instigated the filing and prosecution of the removal action.
Pay attention themis!
If the judge temporarily appoints someone to replace Tyler, the APPOINTEE has to post the bond, NOT the person(s) filing the petition.

southtexas,
>"And yes, you guys are showboating....the worst kind of showboating. Ranting, accusing, proclaiming and all anonymously. You are getting attention without any of the direct responsibility....no people calling you on the phone and questioning your actions...YOU ARE ANONYMOUS!!!"<
At least one of us will file the petition and will no longer be anonymous. By the way, I don't see you or themis giving the world your true identity. What gives is it "do as i say, not as I do?". You're really boring southtexas, go stand in front of a mirror and whine, at least it will look like someone is paying attention to you.

I've said it before, but I'll say it again for your benefit - it's easy to spot the avatar by my posts and easy scroll right by my comments - just ignore them if it bothers you so much - lots of other people are posting interesting comments for you to enjoy. Have a nice day. :- )

Themis, stop practicing law without a license. You don't understand the procedures. I'm sure you haven't spoken with an attorney on the matter either. The bond you are talking about is about the temporary appointee to the District Attorney's office IF he/she is temporarily removed while the investigation is ongoing! The money comes from a general fund by the county. You do realize that all this is online for the public to read, right? The person filing the petition is NOT the temporary appointee!!

It is not up to us to decide if the District Attorney is guilty of any of the allegations. Just as it is NOT up to the District Attorney to decide if the people brought forth are guilty of any allegations. There is a legal process set up (been there for hundreds of years) for this very thing. But we do have a civic duty to take legal action if we feel something is not right in our local legal system. And that is what we are doing.

And indeed I am anonymous....however I am not part of a group that is starting a frivolous legal action against an elected official. If you are going to do something that gutsy then at least have the chihones to state who you are. Tyler has the guts to stand up for what he believes, but you guys are too chicken to stand up to disagree with him. What wimps!!!!

You can bet if I felt strongly enough about something to start a legal action I would make my identity known.

As far as avoiding your avatar....what a pompous statement. In other words....I am gonna run this show....I am going to post my opinion in every discussion....I am going to intimidate, criticize and rant as seen fit and those who disagree should not read what is written here because I don't appreciate the disagreement. You are so full of yourself you are indeed going to explode at some point in time.

In the words of whoever that Russian comic is: "I luf this country!"
Shurlee and the "Victoria 10" can find a cause they believe is worth devoting their time, effort and resources to fix for the benefit of the citizens of Victoria and Themis, southtexas and the rest of us can sit in our homes and either agree with them, as I do, or not as Themis and ST obviously don't. We all can read the law. We all can understand it to varying degrees. (Thanks to Denny and some of the more legally literate constituents for assisting with that!) We can all second guess the situation and thereby form an opinion one way or another on the issue. We are all at liberty to investigate more thoroughly by actually contacting the people involved and poring over the paperwork at issue. We ALL have that right and that privilege in this country.
Fortunately for many of us, a FEW have the "cajones" to get off their collective butts and do something about it.
I really don't think that's occasion to call these citizens showboaters or grandstanders, southtexas. You don't have to agree with them and you're completely free to say so - even in the strident way you've chosen to do so - but I think a bit more self-control might be in order. Both for the decorum of this medium and in the interest of, at some point, quite possibly having your discourse fed to you. With the tenor of your posts, I expect that if and when that time comes, those feeding them to you aren't gonna be in a mood to sugar coat 'em much.
Congratulations on moving forward with this, Shurlee, wethepeople, et. al. If there's anything I can do, you know where to find me.

SouthTexas, from reading your posts "all over these forums", you obviously represent the DA office and Michael Ratcliff. That gives the impression that you in concur with them in regards their blatant disregard of the Statutes and Codes of the Texas Code of Criminal Procedure. You obviously also do not believe in the rights of citizens to peacefully meet and challenge the conduct of an elected official. Whether or not the name, "Victoria 10" implies representation of ALL the people of Victoria County, it does however; represent those of like mind who feel it necessary to petition for the removal of Tyler whom has been derelict in duty. This group may call itself whatever name they choose. Just like you could call you, Tyler and Ratcliff, "The Three Amigos" or "TresPuckeredPrickleyPears". You and Tyler represent your own pompous opinions and Tyler; indeed with his Narcissistic personality does assume the position and need to be in the limelight.

It is your opinion that “This Victoria 10 thing is ridiculous”. It is my opinion, that, “The Victoria 10 Thing” is not! However; there is gross negligence on one side of the road and that is the side where the DA has REFUSED TO REVIEW 360+ criminal cases. I don’t know what criminal attorneys you are talking to (and don’t need to) but I know what attorneys I have spoken with. Of those that I have communicated with, most are not in Victoria County. Our SO and VPD law enforcement officers already sign their paperwork swearing to the validity and accuracy of their cases. Why has not the DPS and the TABC been required to do the same? SouthTexas, how sly of you to include the “latest news” (from Themis’ blog) of a man who was imprisoned for 26 years for a crime he did not do. That is truly horrible. BUT, for the record and for the misinformed, this was NOT in VICTORIA, had nothing to do with our local judicial system. So, please don’t attempt to spin that story otherwise or elude to the possibility that this was in Victoria and concerned our VPD.

You say, “I am a "tough on crime" person. I believe in the death penalty!”
My questions, “So that comment substantiates and validates your perception of justice? So Tyler, like McGruff. . . is tough on crime? So when is Tyler going to begin taking a bite out of crime?”

You say, “I believe the bad guys should be gotten off the street”.
I say, ‘why the hell are you in favor of allowing Tyler to let them walk with his refusal to review the cases? You can not have it both ways’.

Speaking of pompous narcissistic individuals, I agree with you on your charge that our DA does have an ego problem. SouthTexas, it is Tyler who has a personal vendetta, and it is against the VPD. And since you know his dealings so well, you absolutely know what it concerns.

<itunes:summary> SouthTexas, from reading your posts "all over these forums", you obviously represent the DA office and Michael Ratcliff.

You say, “What I do not believe in is the D.A. having to take cases that are going to get tossed because of sloppy police work”. I say, “Tyler is the Tosser”, no one else!” He has self endowed himself as Judge, jury and executioner in axing cases before they are presented and refusing to review them, period. 360 plus cases as of Friday.

Could it be Tyler's inspector, "The Watcher'? naw, he ain't literate enough to know about tilting at windmills....
Or how about "Atticus Finch" himself, since he really believes he's the top cop in town?
Maybe it's themis, at least he's educated enough to recognize the name Cervantes but often mis-spells words - it's spelled Quixote by the way ( maybe he thinks of himself as Dulcinea).
Suggestion to Tyler supporters: If each one of you would post comments supporting him under ten different names, it would appear as if he had a ground swell of support.
Oh well.....hohum.....yawn.....zzzzzzz

Shurelee et al, Congratulations on the progress so far! IMO regardless of the outcome you all stood up for what ya'll believed in, which is more than I can say, and you brought a very serious issue to light. The people in Victoria can see that they actually do have a say in what happens to their town. With the article in todays paper about upcoming mediation maybe you have made an impression on Tyler & will make him do something, anything, which would be better than what he is currently doing. Keep up the good work & keep us posted! Looking forward to some good in 2008.

THEMIS and southtexas, it is obvious that you totally support the DA in his quest to dominate the local law enforcement community, will you continue to blatently support him when the criminals he is currently to go free on nothing less than a PR bond viantly assualt and injure the members of this community? Will you stand and be accountable for their actions as the proper course of action for our DA?
When that day arrives, I do not think we will be hearing much from either of you, but I won't be bothered by your absence.

Jan 9, 2008 at 04:01 PM : What bothers...

What bothers me is that Mr. Tyler has, in my opinion, essentially chosen to forsake the victim's of crime and their quest for justice by using their plight as a lever or tool in his "feud" with local law enforcement. Even if Tyler were to have a legitimate "beef" with the police, his way of going about trying to force them to comply with his wishes (i.e. not reviewing or filing charges unless his affidavit is signed) is just plain wrong, after all the victims of crime didn't have any part in the feud. I feel the fact that Tyler did not create or require the signing of this affidavit until long after the feud with law enforcement had begun, when combined with the fact that not another county in the state of Texas uses one like it, really speaks volumes about Mr. Tyler and his motivation. I would also ask why the Chamber of Commerce and the Victoria Economic Development Board haven't weighed in on Tyler's refusal to review criminal cases and prosecute offenders? After all, they have to "sell" Victoria to prospective businesses and industry that may be considering locating in Victoria and having to "two-step" around the fact that we essentially don't have a functioning criminal justice system surely can't be helping their cause or that of our city.
I am sorry that it has gotten to the point that legal action seems to be the only recourse, but I also believe that enough is enough.

Enough is enough, I agree. Tyler's mission should be to see that justice is done by providing the highest quality legal representation for the public and individual victims of crime. This is not happening as cases are stacked, stack, upon stack. Along with that, his mission should be to live up to the oath he swore to when taking office on January 1, 2007. Tyler is NOT contributing to the efforts of the criminal justice system nor has he attempted to strengthen our community. He is to represent the state and victims of crime in the prosecution of felony offenses committed in Victoria County. His track record speaks for itself as does the stacks and stacks and stacks of "refused to review" cases. The oath he had sworn to do . . . this he has NOT done.
