This employee needs to contact the Workforce Commission. If he were "fired" or "let go", he may be entitled to unemployment benefits.
I'd also recommend that he talk to an attorney. Call around locally. Many attorneys have a free or a "cheap" initial consultation. I don't know much about Texas Employment Law, but I have heard that if you are injured on the job and are under a physcian's care, you cannot be fired. Now, when the employee returns to work after being cleared by the doctor, the employer can then use the "at will/at leisure" termination.... they aren't required to give a reason. Except if they are disputing the unemployment benefits.
