You need to hire an attorney from outside of Victoria County. Go to San Antonio, Houston, or Austin. Good luck.

txgasman: You are far more forgiving than I am. If someone entered my property, trying to inflict harm on any member of my family, he would only leave my property horizontally. Contact an attorney, and explore your rights as a citizen protecting yourself and/or a third person. Also look into your rights that pertain to protecting your property against trespassers. This will prove to be beneficial reading for you.

Deborah Branch is quoted in this story. Do not forget her role in Steve Tyler becoming DA. Deborah Branch allowed herself to be used by the power brokers to run a write-in campaign to throw the election to Tyler. Follow the money. Deborah Branch is neither credible nor believable on anything concerning the DA office. She is part of the story of this scandal and one of the players.

Psychological mind control of a person can be very damaging. Even adults have a rough time; take the battered woman, who keeps going back, because of brain washing emotions,threats, etc.... So now the person comes to terms with his issues and speaks out. Thank god that someone is finally listening to his cry and something is being done. Others need to come forward. Let's pray that the official's investigation goes deep for there is a problem in this community. Mr. DA Tyler should not prosecute this case. He will not stand up for the person. This learned lesson from a previous trial of a child who was molested(by someone else). The sheriff's office (under Ratcliff) took their time in starting the investigation after the initial report. Mr. Tyler was the assistant DA for the trial. The person was acquitted with an 11 man 1 woman jury. So take a walk in the shoes of the children; for the next chid may be yours.

Please, let's get something straight about this "DPS investigation." Having been a victim of the poor practices of the Texas Department of Public Safety I can safely and assuredly say don't always believe everything your see and even less of what you hear from that tainted state agency!

Well, I can only speak from what my family and I have experienced. The whole incident with Mr Kelley dragging his feet in proceeding with the Order of Protection happened in late 2006. there was an assault in January of 07 and I'm hoping that Mr. Tyler will not arbitraily pass on the case. However, my wife and I have been told to "move past it" and "get on with our lives". We have our kid in therapy, spending a major amount of money on it too, and this preditor is walking the streets and there isn't any legal avenue to get him behind bars... I hope Mr. Tyler will accept the case, but from the rumor and conjecture, nothing is encouraging.... I'm out

To txgasman: I visted with the DA and learned more about this so-called "rift". It seems that the DA cannot go forward with a true explanation because it covers many pending trials and to comment about pending trials is not only a violation of law but could taint a potential juror. The DA is more interested in preserving the future of pending trials that what he looks like to the public, for now. The police are not held under the same law and can comment all they want. I feel that the police know this and are playing along this line to make the DA, a more deanding DA, look like a fool. Find anyone that has been a recent victim of any crime and see if they feel the police did a good job. Most people find their own evidence and turn it over! Within the next year we as the public will have a clearer picture of what has been going on once the cases currently pending are finalized in the judicial system and the DA can speak freely about what was going on.

Go to the DPS website where they list sexual offenders and where they live. There are more than a few in our city.

An even bigger problem is that if he's given probation and he doesn't resign. It will be great knowing we have a pedophile/molester helping make victoria a better place to live.

Lets see if I have this right...

PR Bond for a guy that has allegedly molested/assaulted a child. My guess is if he is already getting this treatment, then if he pleads out, he'll be hit with some fairly rough probation. Even if it goes to trial and he's found guilty, my bet is they somehow find a way to put him in some easy going place for a year or so and then a few years probation.


Sometimes justice doesn't really do what it is supposed to.

Where is Jack McCoy(Law & Order)when you need him???

I do not believe that the DA's office in Victoria County is very interested in prosecuting sexual assault cases. Especially ones involving children. Having said that, let me add that the Victoria Police Department and the Special Crime Unit of the Sheriff's Department work very hard to get the scum off the street. There are several investigators with both entities who work diligently to bring these cases to justice. But, when presented to the DA's office, are dismissed.

I personally have witnessed such. We tried to get an order of protection against the "alleged" pedophile scum bag maggot who hurt our child....Mike Kelley hemmed and hawed around for nearly 8 weeks, and then lied to us about the whole thing....The cretin was arrested outside our home and was given a criminal trespass warning, an when he violated that, still nothing was done.... We even tried to file a pro se application for a protective order, but it didn't fly. A month later, he got to our child and did more damage.

Yes, the Police and Sheriff's department were doing all that they could do and we're grateful for that. But basically, because of what is going on at the DA's office, we aren't holding out much hope that this child molestor will be brought to justice. It's sad because we know the law enforcement agencies have done what they could to help, and the good people at Hope of South Texas as well as private therapists.... but there are scars on the whole family that will never completely heal. I don't wish anything like this on any other family, but maybe if this offender acts again, he'll be put behind bars where he belongs.... I doubt it'll happen here in Victoria, though.
