You are correct……

He CAN REQUEST, but he CAN”T DEMAND the additional paperwork. There is NO law on the books that says the VPD or the S.O. HAVE to comply.
One more point, Tyler is NOT “requesting” state agencies (TACB and DPS) to sign his affidavit. He can’t legitimately demand that some agencies do it and not require it of others.
The walls are closing in on Mr. Tyler because of his poor decisions. Hide and watch.....

Magnum, your arguement is weak. If this affidavit is in fact the same kind of paperwork officers are already signing, then what is the holdup? Sign the affidavit and get on with the job. Many of us in our own line of work are faced with the same kind of redundant paperwork everyday. So that brings me to my point. What is the REAL reason officers won't sign it? Because David Smith says not to or because they will be responsible for presenting an "honest" and "thorough" case to the DA? I've read all three versions of the document and it DOES NOT say nor imply what Mr. City Attorney is telling the public.
Denny Crane, Chief Ure greatly inflated the number of declined cases his office has received from the DA, which is certainly an error on his part. Just one example as you asked!!

Are you saying that City Attorney Smith and Victoria Police Chief Ure are NOT obeying the law by not signing the “Tyler-Invented affidavit”? Identify the Texas Civil Statute you are referring to. They are not disobeying any law because there isn’t one.
And, Which local media has reported “errors” being made by local Law Enforcement? What were the errors that have been reported? Where were they reported and Who, exactly was reported? Not signing a Tyler-Invented affidavit is not an error.
The focus is in the right direction. It is on Tyler. Obey, the law, you say? I suggest that you tell your boss, Tyler to begin doing his job, read Chapter 2 of the Texas Code of Criminal Procedure, Article 2.01. and then you can also go to the DA’s website-

The main duties of the county and/or district attorney is to represent the state in criminal cases. The county and/or district attorney works with [not against] law enforcement officers in the investigation and preparation of cases to be heard before the criminal courts.
If, I am right about your boss being Tyler, I suggest, as you soon may be looking for another job, that you leave out the part about working for Steve Tyler on your resume. No one of integrity would hire anyone that currently works with or for Tyler after all of his arrogant pomposity, incompetence, misuse of power and his failure to carry out the duties he was elected to do.

simpl4u2si do you have any type of law enforcement experience. I don't think so because if you did you wouldn't be saying "what's one more legal piece of paper?" about this. The amount of paperwork required for one arrest while varying by agency is still tremendous (I have had arrest reports that took 8-10 hours for one arrest because of the crime committed) and in that paperwork there is already a paper that does pretty much the same thing as what he's already asking for. It is going to be in the form of a P.C affadavit (Probable Cause Affadavit that is sworn to before a warrant for arrest or search warrant is issued by a magistrate.) The other possibility is an on-sight affadavit that is filled out when offense is committed in presence of or if officer makes immediate arrest. This form must also be sworn to. What Tyler is asking local law enforcement to do is redundant in that it's already being done as part of the regular course of business for these agencies. If you don't want to believe me there is a book called the Texas Code of Criminal Procedure. Read it. It will tell you exactly what is required BY LAW. I agree that mediation at this point is not only not needed it is a stupid waste of time for officers and administrators who are already overworked. Keep up the good work VPD and VCSO.

I have to say this: The VPD and the VCSO are still doing their jobs.... and doing them well! Yes, we have our share of crime, but this isn't 1950 and it isn't Mayberry! But it could be so much worse! There is a lot of gang activity in Victoria, but the cops are on top of that! That's why it isn't any worse than it is. Sure there are murders and shootings, rapes, drug deals, etc.... but look at how many arrests are made each day! Thank goodness this rift hasn't affected the job the Police Officers and Sheriff Deputies are doing!

As reported in the Advocate, Mr. Tyler is well within the law to request the additional paperwork. Or did everyone miss that point? One extra form allowable under the law! Ask Mr. Smith how many times he or his peers, the City Department Heads and City Management have required city employees to add yet another "so called needed or required form or changed their job description or duties" without the employees wanting to sign it, but they claimed it was allowable for them to require the employees to do so under the law. This sounds like the pot calling the kettle black.
The local media has also reported on the errors being made by the law enforcement agencies. These agencies claim
to have new pitchers and will be new an improved but they have proven again and again they are the same only team with new uniforms. Would not Mr.Smith say -laws and rules are made because of a few?
The focus needs to change from the he did - she did -he said - she said and everyone needs to follow the law. And the focus needs to questioning why the City Manager-Windwehen and City Council are allowing the City Attorney and Police Chief to operate to the contrary. Let's see fellas - tilt your head back - pinch off your nose - open your mouths - and take a dose of your own medicine. Uummm, ain't that good!
Obey - the law.

I am establishing the “Remove Tyler Fund” today! Steve, you are an embarrassment to our community and your profession. We, the registered voters of Victoria County, are not going to take it anymore! I will post details later this week on where to donate and what it is going to take to rid our County of this joke of an official. I have seen one term elected officials do a lot of damage, but WE CAN NOT AFFORD to have you complete even one term!
I am calling the Attorney General’s Office today to see what is the exact number of signatures needed on a countywide petition to remove an elected official from office and to whom these signatures would need to be presented? I don’t believe it will be hard to get the signatures at this point.
For those that actually did cast votes for this man, I feel for you. You have been betrayed and your support made a mockery.

At this point it appears mediation may be the only course left to settle this situation. As a taxpayer, I would like all entities involved to agree to mediation so we can get on with the business of law enforcement in Victoria County. I am tired of this pissing match about who is right. T. Michael, Mr. Smith, Chief Ure, Mr. Tyler, pull a chair up to the table and let a third party hammer out a solution. This has gone on way too long. Men, this county needs you to step up to the mediation table and forge an agreement. The county is suffering and needs you to do the right thing, now.

This is a big joke.
Is Tyler really serious?
If he would like to do what's ethically right he would just resign and do us all a favor.
Tyler should get some sleep and wake up in the morning then come to his senses. Wonder how his wife feels about his behavior. If my spouse behaved in this manner I would bonk them on the head and say "GET REAL !"
The DA's office is the hot topic for jokes !
